Welcome to Nourish Nutrition Tracker ("App", "Service", "we", "us", or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Nourish App regarding your use of the Nourish mobile application and related services.

By downloading, installing, accessing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our App.

2. Description of Service

Nourish is a comprehensive nutrition tracking mobile application that provides:

Core Features

• Personal nutrition goal calculation and tracking
• Food logging with nutritional information database
• Barcode scanning for food identification
• AI-powered food recognition and nutrition analysis
• Water intake and weight monitoring
• Progress analytics and health insights
• HealthKit integration for Apple Health sync
• Group features for accountability and progress sharing

Educational Purpose

• Nutritional information and tracking tools
• Health goal setting and progress monitoring
• General wellness and nutrition education
• Personal data visualization and analytics

4. Privacy and Data Protection

Data Collection and Use

• We do not collect any personal information - our Privacy Policy reflects this commitment
• We are committed to protecting your privacy through a no-data-collection approach
• Your health data is stored exclusively on your device and optionally in your personal iCloud account
• We cannot sell, rent, or share your personal data because we do not have access to it

5. Subscriptions and Payments

Subscription Tiers

Nourish offers the following subscription options:

• Free: Limited AI food scans per month, core tracking features
• Plus: Increased AI scan limits, additional features
• Premium: Highest AI scan limits, all features unlocked

Billing

• Subscriptions are billed through Apple's App Store on a monthly or yearly basis
• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your App Store account settings

Refunds

• All purchases are processed by Apple and subject to Apple's refund policy
• To request a refund, visit reportaproblem.apple.com
• We cannot process refunds directly as payments go through Apple

Free Trial

• Some subscription plans may include a free trial period
• If you don't cancel before the trial ends, you will be automatically charged for the subscription
• Unused portions of free trials are forfeited when you purchase a subscription

6. Your Content

• You retain full ownership of all personal data and content you input into the App
• We do not require any license to your data since we do not access or process it
• You represent that you have the right to store any content you input on your device
• We do not and cannot claim ownership of your personal health and nutrition data

7. Third-Party Services

Nourish integrates with the following third-party services:

AI Food Analysis

• Food photos are analyzed using Google Gemini or OpenAI APIs
• Images are processed in real-time and not stored on our servers
• AI providers may retain data according to their privacy policies
• Nutritional estimates from AI are approximate and should be verified

Apple Services

• HealthKit: Optional sync with Apple Health for nutrition and fitness data
• CloudKit: Group features use iCloud for data sync
• Sign in with Apple: Optional authentication for group features
• App Store: Subscription billing and management

Analytics

• We use TelemetryDeck for privacy-focused, anonymous analytics
• No personal data or health information is collected

8. Acceptable Use Policy

Permitted Uses

• Personal nutrition and health tracking
• Educational purposes related to nutrition and wellness
• Sharing the App with friends and family (subject to these Terms)
• Exporting your personal data for health records

Prohibited Uses

You agree NOT to:

• Use the App for any unlawful purpose or illegal activity
• Share false, misleading, or harmful health information
• Attempt to reverse engineer, hack, or compromise the App
• Upload malicious code, viruses, or harmful software
• Violate any applicable laws, regulations, or third-party rights

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

No Warranties

• We disclaim all warranties, express or implied, including merchantability and fitness for purpose
• We do not warrant that the App will be error-free, uninterrupted, or secure
• No warranty is made regarding the accuracy of nutritional information
• We do not guarantee that the App will meet your specific needs or requirements

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF THE APP.

Excluded Damages

• Direct, indirect, incidental, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Personal injury or health-related damages
• Damages resulting from third-party services or content

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting in the App. Continued use of the App constitutes acceptance of modified Terms.
